Construction titans clash as the DM model crumbles: A legal battle unfolds
In a recent legal development, the High Court has stepped in to mediate a dispute between key players in the construction industry. On November 12, the court issued an interim order, halting any financial transactions involving the Ministry of Transport and Infrastructure, Absa Bank, and Pro-Serve Consulting. This decision came as a response to Tau Grading's urgent application, seeking to protect funds allocated for the Modipane–Mabalane road project.
The story begins in October 2024 when Pro-Serve engaged Tau Grading for construction work on the Modipane–Mabalane road, funded under the DM model. However, tensions arose in September when Tau Grading suspended operations due to non-payment. Pro-Serve, in an attempt to resolve the issue, instructed Tau Grading to continue their work, citing a contract clause that mandates government payment before contractor compensation. This clause has now become a central point of contention.
The court's interim order not only restricts financial transactions but also aims to safeguard the construction project's progress and ensure Tau Grading's exclusive possession of the site.
